Terms & Conditions

1. Agreement to these terms
These Terms and Conditions govern your use of pnwpoolsandconcrete.com, referred to here as the Site, operated by Pacific Northwest Pools and Concrete Design LLC, referred to here as PNW Pools, we, us or our. By using the Site, submitting a form or contacting us through it, you agree to these terms. If you do not agree, please do not use the Site.

 

2. What we do
We are a design-build contractor in western Washington. We build custom shotcrete/gunite swimming pools, hand-carved artificial rock waterscapes including grottos, waterfalls, waterslides and swim-up bars, fiberglass pools, and concrete and hardscape work including patios, pool decks, driveways, walkways and retaining walls. We hold Washington contractor license PACIFNP750J5.


We do not provide pool cleaning, chemical service, weekly maintenance or any other ongoing pool care, and none is offered through this Site. If you need that work, ask us and we will point you toward someone who does it.

 

3. The Site is information, not an offer
Everything on the Site, including descriptions of our work, packages, features, materials, timelines and any pricing or starting figures, is general information. It can change at any time without notice. Nothing on the Site is a bid, a quote, an offer or a contract, and nothing on the Site obligates us to perform work.


Work begins only under a written agreement signed by both parties, such as our Swimming Pool Construction Agreement. If anything on the Site conflicts with your signed agreement, the signed agreement controls.

 

4. Consultation requests
Submitting the consultation form or calling us does not create a contract, reserve a place on our build calendar or commit either of us to anything. Budget ranges you select on the form are for our planning only. Real pricing depends on site conditions, soil, water table, access, permits, engineering and final scope, all of which we assess in person.


We reserve the right to decline any project for any lawful reason.

 

5. Portfolio images, reviews and results
Every project we build is custom. Photographs and video on the Site show completed work for specific clients on specific properties, under conditions that will differ from yours. They are examples of our craftsmanship, not a promise that your project will look the same, cost the same or take the same amount of time.


Rock carving, staining and concrete finishes are done by hand, so color, texture and shape vary from one project to the next and from a photograph to the finished work. Variation is a characteristic of hand-made and site-poured work, not a defect.


Reviews and testimonials on the Site are individual experiences shared by real clients. They are not a guarantee of the outcome of your project.

 

6. Our intellectual property
The Site and its contents, including text, photographs, video, graphics, the PNW Pools name and logo, page layout and design, are owned by us or licensed to us and are protected by copyright, trademark and other laws. You may view and share pages of the Site for your own non-commercial use. You may not copy, republish, sell, scrape or use our content for another business, including to train an artificial intelligence system, without our written permission.


Concept sketches, clay models, renderings, plans and construction drawings we prepare remain our property unless your signed agreement says otherwise.


7. What you send us
If you send us photographs of your property, measurements, plans, inspiration images, messages or a review, you confirm that you have the right to share them and you give us permission to use them to respond to you and to carry out the work. Do not send us anything confidential that you do not want us to act on, and do not send us material that belongs to someone else.


If you post a public review of our work, we may repost it on the Site and on our social media.

8. Acceptable use
When using the Site, you agree not to:

  • Submit false information or impersonate another person

  • Use automated tools to scrape, copy or harvest content or contact information

  • Interfere with the Site, its security or its normal operation

  • Send spam, malware or anything unlawful through our forms

  • Use the Site or its content for a competing business

 

9. Links and third-party services
The Site may link to manufacturers, review platforms, social media and other outside sites. We do not control them and we are not responsible for their content, products or practices. A link is not an endorsement.

 

10. Disclaimer
The Site is provided as is and as available. We work to keep the information on it current and accurate, but we do not warrant that it is complete, error free or uninterrupted. To the fullest extent allowed by law, we disclaim all warranties relating to the Site, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.


This section is about the Site only. Warranties on construction work are set out in your signed agreement and its warranty exhibit, and nothing here limits or replaces them.

 

11. Limitation of liability
To the fullest extent allowed by Washington law, PNW Pools and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or your reliance on anything published on it. Our total liability for any claim relating to the Site will not exceed one hundred dollars.


This limit applies to the Site. It does not apply to work performed under a signed construction agreement, which carries its own terms, warranties and remedies.


12. Indemnification
You agree to defend, indemnify and hold harmless PNW Pools and its owners, employees and agents from any claim, loss, liability or expense, including reasonable attorney fees, arising from your misuse of the Site, your violation of these terms or your violation of anyone else’s rights.


13. Governing law and disputes
These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Any dispute relating to the Site or these terms will be brought in the state or federal courts located in King County, Washington, and you and we consent to the jurisdiction of those courts.


If you have signed a construction agreement with us, that agreement governs any dispute about the work, including how and where it is resolved.


14. Changes to these terms
We may update these terms as our business or the law changes. The effective date at the bottom shows the most recent version, and your continued use of the Site after a change means you accept it.


15. General
If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. You may not assign your rights under these terms. We may assign ours in connection with a sale or reorganization of the business.
